The agreement between you and Choose Your Lender. We've kept it as short as the subject allows and put a plain-English translation next to every section that matters.
Agreeing to these terms
These Terms of Service form a binding agreement between you and Choose Your Lender ("we", "us", "our") governing your use of this website and any related services. By browsing the site, creating an account, submitting an enquiry, or listing a profile, you accept these terms.
If you don't accept them, please don't use the site. If you're accepting on behalf of a company or brokerage, you confirm you have authority to bind that organisation.
Using the site means you agree to these rules. If you're signing up for your brokerage, make sure you're allowed to.
What this service is
Choose Your Lender is an online directory and information resource. We do three things:
- Publish profiles of licensed mortgage professionals so consumers can find and compare them.
- Pass consumer enquiries to the professionals those consumers choose to contact.
- Publish educational content — articles, guides, videos, podcasts, and calculators — about home financing.
That's the whole service. We are an introduction and information platform.
We are not a lender, broker, or adviser
This is the most important section on the page.
We do not originate, fund, service, or broker loans. We do not accept loan applications, make credit decisions, set interest rates, issue approvals, or lock rates. We are not a mortgage broker, mortgage banker, correspondent lender, financial adviser, tax adviser, or law firm.
Any loan you obtain is a contract between you and the lender or loan officer you choose. We are not a party to it. We receive no commission on the loans that result from introductions made through this site, and we have no role in whether an application is approved or on what terms.
Nothing on this site is an offer or commitment to lend, an offer to enter into an interest rate lock, or personalised financial, legal, or tax advice.
We introduce you to loan officers. We don't lend money, we don't decide whether you qualify, and we can't promise you any rate. Your loan agreement is with them, not with us.
Who may use the site
You must be at least 18 years old and legally capable of entering a contract. The site is intended for use in the United States and is not directed at people in jurisdictions where its content would be unlawful.
You may not use the site if we have previously terminated your access, or if you are barred from receiving services under applicable law.
Accounts and security
Some features require an account. When you create one, you agree to give accurate information and to keep it current. You are responsible for everything that happens under your account and for keeping your credentials confidential.
Tell us promptly if you believe your account has been accessed without your permission. We may suspend an account at any time if we reasonably believe it has been compromised or is being used in breach of these terms.
Acceptable use
You agree not to:
- Scrape, crawl, harvest, or bulk-download profiles, contact details, or content, or use automated means to access the site except for well-behaved search engine crawlers.
- Use contact details found on this site to send unsolicited commercial messages.
- Impersonate another person, or misrepresent your identity, licensing status, or affiliation.
- Submit false enquiries, fake reviews, or content you know to be inaccurate.
- Interfere with the site's operation, probe its security, or attempt to gain unauthorised access to any system or account.
- Post content that is unlawful, defamatory, harassing, discriminatory, or that infringes anyone's rights.
- Use the site to violate fair lending law, including the Equal Credit Opportunity Act and the Fair Housing Act.
Don't scrape the directory, don't spam the people listed on it, don't lie about who you are, and don't post things that break the law.
Additional terms for listed loan officers
If you list a profile on this site, the following also applies to you.
Accuracy and licensing
You warrant that you hold every licence and registration required for the states in which you accept business, that your NMLS identifier is accurate, and that your profile — including your specialties, states served, and employer — is truthful and kept current. You must update your profile promptly when any of it changes, and tell us immediately if a licence lapses, is suspended, or is revoked.
Compliance
You are solely responsible for the compliance of your own content and communications, including advertising rules, trigger-term disclosure requirements, state-specific licensing disclosures, RESPA, TILA, the TCPA, and fair lending law. Nothing we provide constitutes compliance advice or approval of your content.
Handling enquiries
Consumer enquiries passed to you contain personal information. You agree to use them only to respond to that specific enquiry, to handle the data in line with applicable privacy and financial data law, and never to sell, rent, or transfer it to a third party for marketing.
Fees and removal
Listing fees, if applicable, are set out in your subscription agreement. We may remove or suspend any profile at our discretion, including where a licence cannot be verified, where a profile appears inaccurate, or where we receive credible complaints.
Changes and termination
We may change these terms. When we do, we'll update the effective date at the top and, for material changes, give notice on the site or by email before they take effect. Continuing to use the site after that means you accept the revised terms.
We may modify, suspend, or discontinue any part of the site at any time. We may suspend or terminate your access if you breach these terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and disputes — will survive.
